Increase to registration fees for land transfers and mortgages in Alberta

Amendments to the Land Titles Act 2000 come into force on October 20, 2024. These amendments significantly increase registration fees for land transfers and mortgages. The amendments are detailed in s 5 of the Financial Statutes Amendment Act, 2024, SA 2024, c 4. The increased registration fees only apply to specific instruments submitted for registration on or after October 20, 2024. Instruments submitted for registration before October 20, 2024, continue to incur registration fees calculated by the Tariff of Fees Regulation, Alta Reg 120/2000. Increase of the capital gains inclusion rate from June 25, 2024

An increase to the capital gains inclusion rate applies to capital gains and losses from June 25, 2024. For corporations and trusts, the rate is increased from one-half to two-thirds. For individuals, the inclusion rate is one-half of the first $250,000 and two-thirds of the remaining capital gain or loss. The By Lawyers publications have been updated to reflect these changes.
